The fact is that the language is in CFR 33, 164.46
"(b) The requirements for Vessel Bridge-to-Bridge radiotelephones in
Sec. Sec. 26.04(a) and (c), 26.05, 26.06 and 26.07 of this chapter also
apply to AIS. The term ``effective operating condition'' used in Sec.
26.06 of this chapter includes accurate input and upkeep of AIS data
fields."
The best I can make out is that if you use AIS and you don't keep the
data updated correctly and it is the proximate cause of an accident, you
will find yourself in the $25,000 flypaper.
I suppose that you could be fined even if it does not cause an accident.
And since you will be transmitting, I suppose that would be "prima facia
evidence" of a violation. I can't find any language that exempts
recreational craft or vessels not required to carry AIS.
Sorry if this isn't quite my usual, I had to dig all over the CFR's and
US Code to get even this much.
If this is not all that CLEAR then please don't ask me for more
clarification.
