The California Air Resources Board (CARB) is at it again.

After losing its attempt to impose unilateral air emissions standards  
on ships operating in California waters (as well as out to 24 miles  
offshore), it issued a Notice stating that, on July 24, it will  
conduct a public hearing in Sacramento to consider adoption of a  
proposed regulation for fuel sulfur and other operational  
requirements for ocean-going vessels within California waters and 24  
nautical miles of the California baseline.

The Initial Statement of Reasons for this proposal notes that the  
earlier rulemaking was struck down as a preempted emissions  
standard.  The approach here is allegedly a fuel-only requirement,  
which the CARB contends can be implemented without prior  
authorization from the US Environmental Protection Agency (EPA).  To  
say that this new effort will be contentious is probably an  
understatement. (6/12/08).
