Jon -- what you are referring to is a possessory lien, sometimes called a
shop lien. I would be careful about agreeing that the boat is always in
your possession unless it actually is. Having possession and control of the
boat but allowing others to use it raises distinct and troublesome liability
issues if there is an incident while under someone else's control.

I wanted to chime in on this issue since I dealt with it many times over the
years while operating businesses doing "Field Service" work on: industrial,
on/off road heavy equipment, aircraft, etc.
Let me note here that "Field Service" is a different animal than a shop
where the equipment in question, be it a vessel/truck/car/track-hoe/vacuum
sweeper/whatever, is physically "in your possession" at the time payment is
required. I.e. the boat yard's willingness to splash your vessel.
