T&T: Charleston - collision caused by failure to follow navigation rules

i have mixed feeling on this one..

if the sailboat crossed safely ahead but then tacked unexpectedly in front 
of the tour boat then he failed to maintain course and speed as required by 
a stand on vessel.  He also failed to maintain a proper lookout, how can one 
not see a tour boat before tacking... or was he trying to force teh sail vs 
power issue ?  The tour boat captain shoudl have sounded 5 blasts as soon as 
the sailboat tacked and done a little more than merely stopping.

also got to wonder why did he decide to go thru a race fleet since he was 
not in the chanel anyway...

and why dind't the coast guard respond right way to the tour boat calls on 
16 after the collision ?
