In a situation where it is unclear what the situation is then the regs
require all precautions to be taken to prevent a collision. In other
words the situation becomes one of "special circumstances". Not a
crossing or meeting or anything; but a special one.

A buoy tender partially blocking a channel is well advised to help
prevent a grounding or possible 2 vessel collision by taking whatever
action the captain feels appropriate. Whistle signals being obvious and
quickly carried out.

A certain level of aggression is necessary in such circumstances or
action may be taken too late to be of help. Our entire culture is
riddled with people who through perhaps no fault of their own have
become acclimated to delaying any action, from a simple fear of being
looked upon as being overly aggressive.

At sea, it is often times preferable for action taken quickly but
implemented poorly than action taken belatedly but done well. Hesitation
may leave no time for correction.
