I probably should have not included the above, or should have been 
explicit that only power driven vessels use the whistle signals to make 
for passing. I suppose that it is so infrequent that a sailboat 
overtakes a power boat.

Having said that, any situation that is not explicitly covered in the 
rules is automatically one of special circumstances and even sailboats 
are not immune to that rule.
