Not sure where the 100 gross tons (each gross ton is a 100 cubic feet of
internal space) became a limiting factor to number of passengers. 100 gross
tons or less is a subchapter T requirement, over 100 gross tons, the vessel
moves into a different set of safety regulations. How could all of the various
pontoon boats in Baltimore or DC operate carrying significantly more passengers
than 6? I used to have a 100 ton license for Sf Bay and Tributaries and
operated several 40' vessels that were licensed to carry 25 - 49 passengers for
hire on those waters.

You have an exemption to the Jones act. Not to the Uninspected Passenger
Vessel Regs. The boat has to be over 100 gross tons to carry over 6.
I can't imagine a DeFever 41 being over 100 GT.
The consequences of violating the UPV regs could cost the operator their
operator/master license, possibly the Jones Act exemption, major fines.
A violation once committed cannot be covered up without committing
felonies, which are more serious than the original violations.
In summary, don't violate the regulations and if a violation has or were
to occur and it came to the attention of the Coast Guard, the only
proper and intelligent course of action is to own up to it, immediately.
As long as there has been no serious injury or damages from a violation,
the consequences can usually be solved fairly cheaply.
I posted this not to pick on anyone in particular. It is obvious that
there is a lot of misunderstanding about this issue and if my comments
keep someone from getting in hot water, so much the better.
