I think it's 46CFR67 Sec. 67.123 (c) and the key would be the
words "clearly visible."

Also (from the USCG website):

"The federal statutes authorize the U.S. Coast Guard to regulate the 
manufacture and safety standards of recreational boats and boating-related 
equipment." These include regulations for 23 categories including "Vessel 
identification system"
