As many of you know, the state of Mississippi assessed a sales tax on our
boat, "Sandpiper". We had stored the boat at Columbus Marina over the
2005-2006 winter season. We felt that this assessment was illegal and
inappropriate to our situation. Therefore we hired a tax attorney and
fought the assessment. After two hearings we were finally able to prove
that we did not fit the criteria of their law. Most states had a time
limit that a boat can stay in their waters without some kind of registration
process and/or a tax payment. The state of Mississippi has NO time limit
and their position was that they pretty much have the right to assess a tax
equal to the difference between their sales tax and the tax that the
transient boat owner had already paid. They feel that they can do this any
time they might chose to do so. Hopefully our case will encourage the
Mississippi legislature to rewrite the tax regulations so that others will
not be caught in the same tax quagmire as we were. We were able to avoid
the tax but our legal bills were well over $15,000.
